COVID-19 Terms & Conditions for Private Bookings

 

 

These terms and conditions have been implemented by Magical Princess Entertainment to adhere to the COVID-Safe Business Guidelines required by the Victorian Government. The person in charge of the booking (The Client/The Party Host) is to observe and act in accordance with the following requirements set by Magical Princess Entertainment, and also maintained by the designated performer(s) that will be doing your event (The Performer(s)). 

 

Please note: these terms and conditions are subject to change based on any Victorian Government restriction adjustments.

 

Location

    1. The Party Host is encouraged to have their performance take place indoors especially during winter months. 
    2. Magical Princess Entertainment requests that this area have adequate shade cover, on flat ground, and respective coverings to protect costumes from any natural elements (example: picnic blanket over wet grass)
    3. Performances may be rescheduled due to weather or factors outside our control, where this happens Magical Princess Entertainment will offer clients an alternative option.
    4. Costumes may be subject to changed last minute if temperature is too high (example: Ice Princesses multi-layered Winter Outfit to her Coronation Dress)
    5. If the Party Host chooses to have their performance indoors, we please ask the following requirements:
    6. The Party Host enhances airflow in the venue by opening windows and adjusting air conditioners.

 

Government Guidelines and Restrictions

There are currently no gathering caps at parks, homes or venues

    1. If the Government Restrictions change prior to the Performance, Magical Princess Entertainment will be in contact with The Party Host to make note of any attendee or performer changes, or to potentially postpone or cancel the event. 

    2. All details provided to Magical Princess Entertainment will be kept private unless requested by the appropriate authorities to be used for contact tracing. 
    3. It is recommended to keep a thorough record of all party guests to simplify the process of giving the details to Magical Princess Entertainment or the authorities if required for contact tracing. 

 

Party Attendees

The following is required of the Party Host and the Party Attendees

      1. The Party Host is responsible to notify Party Attendees of all safety guidelines and requirements prior to the Event Date.
      2. The Party Host is responsible to ask guests who appear or feel ill, or who have been in contact with anyone who may have/has COVID-19, to stay home and not attend the Performance.
      3. It is up to the Performer’s discretion to leave the party if they deem safety procedures have not been followed, with full pay and without repercussion.

 

Performers

Magical Princess Entertainment agrees to take reasonable steps to ensure the safety of the Client, their Party Attendees and their Performers.

      1. Any Performer who has had a fever, been ill, or have been in contact with someone who may have contracted COVID-19, will be replaced by another Performer. If Magical Princess Entertainment is unable to do so, the Party Host will receive a full refund.
      2. Performers are to carry hand sanitizer with them at all times, and use them periodically throughout their visit. 
      3. All performers will be fully vaccinated by or after the 5th November, only fully vaccinated performers will be sent out to parties and events. 

Cancellations

Please note that ‘The Magical Princess Guarantee’ will not be valid for any COVID-19 related issues or cancellations. This includes but not limited to:

  1. If Magical Princess Entertainment needs to cancel for any COVID-19 related issues with our performers. If our Performer is unable to attend your event, Magical Princess Entertainment will make all attempts to find a replacement. If the original Performer has already picked up their costume, we will try to find a different costume related to the character you have chosen, but please be aware we only have a limited number of costumes and this may not be possible. If we cannot attend you will receive a refund depending on your original payment method. If through PayPal, this will be minus the PayPal processing fee, which is 2.6% + 30 cents per transaction as of 17/09/2020 and is subject to change without notice.
  2. If your event needs to be cancelled due to changes in government regulations. (example: changes to limits on the number of people in gatherings) the non-refundable deposit of $100 will be kept, any money paid over this amount will be refunded. This also applies to any global or national crisis or event which causes widespread disruption to the normal operation of the areas that Magical Princess Entertainment operates and the population that resides therein. 
  3. If the Performer feels it necessary to leave during a performance, they reserve the right to leave at any time if the guidelines in this document have not been adhered to. (example: if there is a visibly sick guest, or if social distancing rules aren’t followed). If a performer has to leave during an event, no refund will be issued. 
  4. If the Party Host has to cancel the event and or reschedule to a date MPE is not available, we would like to remind you that Magical Princess Entertainment is happy to provide a refund in most circumstances, excluding the $100 non-refundable deposit. This deposit can be transferred to a future booking that takes place within 12 months of the date of the original event. Please make sure you give as much notice as possible.
  5. If you pay through our shop system and MPE does not have availability, the $100 deposit is non refundable. 
  6. Any other scenarios not listed above will be judged on a case by case basis using the above as a guide. Magical Princess Entertainment will choose how to proceed at our discretion. 
  7. Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 12 weeks.

 

The Party Host/Client is responsible for the health and safety of all guests present. Magical Princess Entertainment cannot be held responsible for any injury or illness contracted by your guests at the event. The Client understands that there is a certain degree of risk that could result in illness, permanent disability, or death.

 

In the event of your gathering failing to abide by current Victorian Government COVID-19 Restrictions, Magical Princess Entertainment reserves every right to not attend your event. If it results in your event being broken up by law enforcement and a fine or multiple are imposed, the responsibility of these fines lies with The Client.

 

If the Party Host/Client does not agree to the above COVID-safe Terms and Conditions, Magical Princess Entertainment and their performers reserve the right to refuse service.

 

By making any deposits/payments-in-full to secure your event date, the Client agrees to the above requirements set and made clear by Magical Princess Entertainment. 

 

 

COVID-19 Terms & Conditions for ‘Princesses In The Park’

 

Version 1.1

 

 

These terms and conditions have been implemented by Magical Princess Entertainment to adhere to the COVID-Safe Business Guidelines required by the Victorian Government. Attendees are responsible to observe and act in accordance with the following requirements set by Magical Princess Entertainment, and also maintained by the designated performer(s) (The Performer(s)) and any assistants (Event Assistant/COVID Marshal) that will be at the event.

 

Please note: these terms and conditions are subject to change based on any Victorian Government restriction adjustments.

 

Location

Princesses In The Park’ are to take place in an outdoor, open air venue or space.

      1. Performances may be rescheduled due to weather or factors outside our control, where this happens Magical Princess Entertainment will offer clients an alternative option.

 

Government Guidelines and Restrictions

‘Princesses In The Park’ are not to exceed the current Victorian Government restrictions in regards to a number of attendees allowed at any outdoor gatherings.

      1. Attendees are not allowed to bring along any additional children or guests. (Infants under the age of 12 months are not included in the cap, but we kindly ask that you refrain from bringing them if possible). TIf any Event Attendees bring along a guest who doesn't have a ticket, their whole group will be asked to leave and no refund will be issued.
      2. If the Government Restrictions change prior to the Performance, Magical Princess Entertainment will be in contact with The Attendees to make note of any changes, or to potentially postpone or cancel the event.

 

Event Attendees

The following is required of the Event Attendees:

  1. Magical Princess Entertainment will only be accepting Attendees who have purchased a ticket prior to the Event. This is to ensure The Attendees agree to the COVID-19 Terms and Conditions, as well as preventing any cash transactions.
  2. Event Attendees consent to their details being gathered for contact tracing.
  3. We ask Event Attendees who appear or feel ill, or who have been in contact with anyone who may have/has COVID-19, to stay home and not attend the Event. To prevent disappointment, we ask Event Attendees to check the children’s temperature and monitor any symptoms a few days before the Event. We kindly ask that Event Attendees communicate with Magical Princess Entertainment prior to the event if themselves or the child is showing any symptoms or has a temperature. Magical Princess Entertainment may, at our discretion be able to transfer your ticket to a new date if given enough notice.
  4. If an Event Attendee or child arrives at the Event with a temperature, or showing visible symptoms of COVID-19, they will be asked to leave and no refund will be issued.
  5. It is up to the Performer’s and the Event Assistant’s discretion to pause or in some cases, cease the performance if they deem safety procedures are not being followed by Event Attendees. If this happens no refunds or compensation will be issued. Please make sure you follow the rules so we can provide you with the most magical experience

     

    Performers

      Cancellations

      1. If Magical Princess Entertainment needs to cancel the event for any COVID-19 related issues with our performer/s or event assistant/s. Magical Princess Entertainment will make all attempts to find a replacement. If we cannot run the event you will receive a refund.
      2. If the event needs to be cancelled due to changes in government regulations. (example: changes to limits on the number of people in gatherings) a refund will be issued. This also applies to any global or national crisis or event which causes widespread disruption to the normal operation of the areas that Magical Princess Entertainment operates and the population that resides therein.
      3. If the Performer or Event Assistant feels it necessary to cancel an event during a performance, they reserve the right to cancel at any time if the guidelines in this document have not been adhered to. (example: if there is a visibly sick guest, or if social distancing rules aren’t followed). If an event needs to be canceled during an event, no refund will be issued.
      4. Magical Princess Entertainment does not offer refunds as a result of a change of mind or changes to personal circumstances that prevent the ticket holder from attending the event. Tickets may be transferred, at our discretion, and only where the transfer can be verified with the original purchaser, and if done in a timely manner up to 2 business days before the event.
      5. Any other scenarios not listed above will be judged on a case by case basis using the above as a guide. Magical Princess Entertainment will choose how to proceed at our discretion.
      6. Where a refund is applicable, this will be minus the PayPal processing fee, which is 2.6% + 30 cents per transaction as of 9/11/2020 and is subject to change without notice, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 12 weeks.

       

      During the current climate, Magical Princess Entertainment has the health and safety of our staff, performers, attendees as our number one priority. Therefore, we reserve the right to make any last-minute changes to our events in response to changed restrictions, illness, etc. Magical Princess Entertainment cannot be held responsible for any injury or illness contracted by your guests at the event. The Event Attendees understands that there is a certain degree of risk that could result in illness, permanent disability, or death.

       

      By purchasing a ticket to Princesses In The Park, the Event Attendees agree to the above requirements set and made clear by Magical Princess Entertainment.

       

       

      Media Release Policy

       

      By attending one of our ticketed events you agree to the following:

       

      I hereby grant Magical Princess Entertainment and their associates the irrevocable right and permission to use photographs, video recordings, and any other type of media known or to be invented of me on any and all media (the Image/s), including but not limited to: websites, publications, promotional flyers and social media, for any other similar purpose without compensation to me throughout the universe for all time, in perpetuity without limitation to the advertising and publicity thereof now or hereafter known, and for any purpose whatsoever.

       

      I understand and agree that such Images of me may be placed on the Internet. I also understand and agree that I may be identified by name and/or title in printed, Internet or broadcast information that may accompany the Images of me. I waive the right to approve the final product. I agree that all such Images, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the sole property of the Magical Princess Entertainment and their associates.

       

      Further, I irrevocably grant the perpetual right to Magical Princess Entertainment and their associates for the use of my name, voice, likeness, appearance and actions to be included therein without compensation, credit or any other consideration.

       

      In addition, I hereby release Magical Princess Entertainment and their associates from any liability for losses or damages to persons or property or for any infringement of my rights.

       

      I have read this release policy and fully understand the contents and agree to the terms, meaning and impact of this release. I will have no right to any claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said Images, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.

       

      U
